Problems with ST3000DM001 Firmware CC9D (But firmware CC9E works!)

I have a number of ST3000DM001 drives in a Norco RPC-4224 server case.

 

If the drive has the CC9D firmware on it, the front green hard drive activity light on the hot swap case is ALAWAY on for the drive. It's very annoying.

 

With the drives I have that are CC9E, the front green activity lights come on when appropriate and works fine.

 

Questions:

 

- Can I update CC9D to CC9E? If so, where and how?

 

- If not, can I RMA my drive to get a drive with firmware of a higher version that works properly for me?

FWIW, I suspect that the difference in behaviour is related to how the drive's firmware implements the ATA standards in respect of pin #11 in the SATA power connector. This pin has the dual functions of staggered spin-up control and disc activity indication. In desktop applications this pin is almost always permanently grounded by the power supply.
