buying another solution, while advisable in hindsight, is something i'd prefer to avoid. i'd also rather not admit i bought a piece of junk.
hence, i went and checked out the apple forums.
anyone else have success with this? seems it works ok.

You can try these steps as a work-around when Time Machine isn't detecting the BlackArmor NAS in Mountain Lion:
- Click Go---> Connect to Server
- Now type in afp://<IP Address of NAS> and click connect
- Enter in the username and password of your account on the NAS
This will open up a window which is the Time Machine backup share on the NAS. You will see an icon appear on the desktop letting you know the share is mounted.
- Open Time Machine and click on "Select Disk..."
- Look for the entry that says "BA_Backup on" <IP Address of NAS>, select it, and click "Use Backup Disk"
- Enter the same username and password for the account on the NAS that was used when you mounted the share and click connect
Time Machine should now be backing up.

I have followed the instructions you have presented and when I enter the log in information on the BA_Backup it does not accept my login and password. I can log into the Seagate Manager for the NAS and I can log in from networked computers to access the drive. Is there anything that could be causing the NAS to not recognize my id and password through time machine? I tried admin and different user logins. I have tried mounting the share to the mac first with no resolution.

I went into the store to see how my replacement NAS is going and another mac user returned his 440 today as well at the same store.
He decided to go QNAP and I am going with a Synology. looking forward to my DS1512+
Not a helpful post, just easier to return it if you are having issues.

Spoonani's link to the Apple Forums worked for me. I tried it earlier and did not work for me. I tried again and signed on with a user that did not have admin rights and it worked. Thanks Spoonani for the link to the Apple forum.

Since I updated the firmware of my BlackArmor NAS 420 to version 4000.1411 your workaround doesn't work any more. Can you please help?

Sorry to hear that it's no longer working. I'll research to see if there's another fix for this and get back with you.
Thank you for your patience.

After upgraded to newest firmware (2000.1331), TimeMachine definitely stop working on both: Lion & Mountain Lion, too.
I can not connect to the volume even with direct IP address as described in the forum. I left public access to the volumes, however, Finder and TimeMachine are not able to connect...
This is really horrible story and support from Seagate... I have issues and problems with this NAS like with no other hardware in my life...
